Kochi: The Kerala High Court has ruled that the amendment to the law making possession of waqf land a crime has no retrospective effect. The decision of the High Court was to quash the case registered alleging possession of waqf land. The case against Calicut Postal Division Senior Superintendent and Marikunn Sub PostMaster was cancelled.
The case was that the post office was operating on the Waqf land illegally. The post office has been functioning on this land since 1999. The Waqf Amendment Act came into force in 2013. A case was filed against the postal officials on the basis of this law. But the High Court pointed out that this act cannot be considered an offense with retrospective effect. The High Court also quashed the case pending in Kozhikode.
